Welcome to The Turn. These Terms of Service ("Terms") govern your use of the mobile web application operated by The Turn LLC ("The Turn," "we," "us," or "our") at getturnapp.com (the "App"). By creating an account or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years of age to use The Turn. By using the App, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. Accounts created by minors will be terminated.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and truthful information when creating your account
• Keep your profile information current and accurate
• Notify us immediately of any unauthorized use of your account
• Not share your account with any other person

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

3. Use of the App

The Turn is a platform that connects golfers to coordinate tee times, fill open spots in rounds, and build a network of playing partners. You agree to use the App only for its intended purpose and in compliance with all applicable laws.

You agree not to:

• Post false, misleading, or fraudulent tee times
• Harass, threaten, or abuse other users
• Use the App for any commercial purpose without our written consent
• Attempt to access other users' accounts or private information
• Scrape, copy, or distribute content from the App without permission
• Use the App to send spam or unsolicited communications
• Impersonate another person or create a false identity
• Attempt to reverse engineer, hack, or disrupt the App

4. Tee Times and Round Coordination

The Turn facilitates connections between golfers but is not responsible for the actual conduct of any golf round. By posting a tee time, you agree that:

• You have a legitimate tee time reservation or reasonable expectation of securing one
• You will make reasonable efforts to honor your posted tee time
• You will notify approved players promptly if you need to cancel
• You are solely responsible for any costs associated with your round, including green fees

By requesting to join a round, you agree that:

• You will honor confirmed commitments to the best of your ability
• You will notify the host promptly if you need to cancel
• You are responsible for your own green fees and any costs associated with joining the round

The Turn is not a party to any agreement between users and is not responsible for no-shows, cancellations, disputes over costs, or any other issues arising from round coordination.

5. User Content

You retain ownership of content you submit to the App, including your profile information, photos, messages, and reviews. By submitting content, you grant The Turn LLC a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the App.

You represent that you have the right to post any content you submit and that it does not violate the rights of any third party.

6. Ratings and Attestations

The Turn allows users to rate and attest to the qualities of playing partners after rounds. You agree to provide honest, good-faith ratings based on your genuine experience. You agree not to use the rating system to harass, defame, or retaliate against other users.

Negative attestations are kept private and are not displayed on public profiles. The Turn reserves the right to remove ratings or attestations that violate these Terms.

7. Prohibited Conduct

The following conduct is grounds for immediate account termination:

• Threatening or violent behavior toward other users
• Discriminatory conduct based on race, gender, religion, national origin, sexual orientation, or disability
• Sexual harassment of any kind
• Repeated no-shows without notice
• Fraudulent tee time postings
• Any conduct that The Turn LLC determines, in its sole discretion, to be harmful to the community

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE TURN LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE TURN LLC IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE. USE OF THE APP AND PARTICIPATION IN ROUNDS ARRANGED THROUGH THE APP IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TURN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS, EVEN IF THE TURN LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Turn LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another user.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the App settings or by contacting us at hello@getturnapp.com.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in San Diego County, California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a new effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
